    The poisons standard 2012, what do changes to nicotine schedules mean for us?

    Hi everyone , im new to this forum, i was a tobacco smoker for 12 years and now have successfully given up with the use of electric cigarettes. I reside in melbourne and am currently vaping 18mlg nicotine.

    My dilemmas are that my workplace has several breakrooms, 2 of these are outdoor balcony break rooms. 1 is for smoking and the other for non-smoking. Been happily vaping away in the non-smoking balcony for many months after permission from management until recently. I was told by a member of our health and safety committee that they had a concern with the vapor that they didnt know if it was safe for other users of the room and that a policy is being put in place to stop me and other ecig users to vape in the room. I was quite angry that it was obviously based on perceptions and not actual studies. So i put all the research together of any vapor studies and put it forth. A victory, they conscede it is safe for bystanders. But she still didnt give up, now she says its illegal and will not be allowed to be vaped on the non-smoking balcony, (not sure about the smoking balcony because i and other vapers refuse to go in there) so again here i go with research. Now it was my understanding that the usage of electronic cigarette nicotine liquid was considered Schedule 2 as it was aid in withdrawal from tobacco smoking in preparations for inhalation.
    The Drugs, Poisons and Controlled substances Act 1981 does not place any restrictions on the personal possession of nicotine if considered Schedule 2 or 6 in victoria. We were allowed to import up to 3 months supply on the personal import scheme.
    However the schedules have now changed

    SCHEDULE 4
    NICOTINE in preparations for human therapeutic use except for use as an aid in withdrawal from tobacco smoking
    in preparations for oromucosal or transdermal use.

    SCHEDULE 6
    NICOTINE in preparations containing 3 per cent or less of nicotine when labelled and packed for the treatment of
    animals.

    SCHEDULE 7
    NICOTINE except:
    (a) when included in Schedule 6;
    (b) in preparations for human therapeutic use; or
    (c) in tobacco prepared and packed for smoking.

    So nicotine e juice is obviously schedule 7 now because as i understand it, ecigs are not recognised as a therapeutic devise and we dont know yet if ecigs are oromucosal delivered. My theory is, it was no secret how we had interpreted the previous 2010 and 2011 poisons standards and the government organisations have completely left no wriggle room for ecig juice.
    So am i missing something?
    Is it illegal? Are we still allowed to import it? Does it just affect the retail of nicotine within Australia? Is it illegal to possess it? Im so confused. Please help

    Oromucosal preparations are solid, semi-solid or liquid preparations, containing one or more active substances intended for administration to the oral cavity and/or the throat to obtain a local or systemic effect. Preparations intended for a local effect may be designed for application to a specific site within the oral cavity such as the gums (gingival preparations) or the throat (oropharyngeal preparations). Preparations intended for a systemic effect are designed to be absorbed primarily at one or more sites on the oral mucosa (e.g. sublingual preparations). Mucoadhesive preparations are intended to be retained in the oral cavity by adhesion to the mucosal epithelium and may modify systemic drug absorption at the site of application. For many oromucosal preparations, it is likely that some proportion of the active substance(s) will be swallowed and may be absorbed via the gastrointestinal tract.



    Oromucosal preparations may contain suitable antimicrobial preservatives and other excipients such as dispersing, suspending, thickening, emulsifying, buffering, wetting, solubilising, stabilising, flavouring and sweetening agents. Solid preparations may in addition contain glidants, lubricants and excipients capable of modifying the release of the active substance(s).

    CLASSIFICATION



    Poisons are classified according to the Schedules in which they are included. The following is a general description of the Schedules. For the legal definitions, however, it is necessary to check with each relevant State or Territory authority.



    Schedule 1. This Schedule is intentionally blank.



    Schedule 2. Pharmacy Medicine – Substances, the safe use of which may require advice from a pharmacist and which should be available from a pharmacy or, where a pharmacy service is not available, from a licensed person.



    Schedule 3. Pharmacist Only Medicine – Substances, the safe use of which requires professional advice but which should be available to the public from a pharmacist without a prescription.



    Schedule 4. Prescription Only Medicine, or Prescription Animal Remedy – Substances, the use or supply of which should be by or on the order of persons permitted by State or Territory legislation to prescribe and should be available from a pharmacist on prescription.



    Schedule 5. Caution – Substances with a low potential for causing harm, the extent of which can be reduced through the use of appropriate packaging with simple warnings and safety directions on the label.



    Schedule 6. Poison – Substances with a moderate potential for causing harm, the extent of which can be reduced through the use of distinctive packaging with strong warnings and safety directions on the label.



    Schedule 7. Dangerous Poison – Substances with a high potential for causing harm at low exposure and which require special precautions during manufacture, handling or use. These poisons should be available only to specialised or authorised users who have the skills necessary to handle them safely. Special regulations restricting their availability, possession, storage or use may apply.



    Schedule 8. Controlled Drug – Substances which should be available for use but require restriction of manufacture, supply, distribution, possession and use to reduce abuse, misuse and physical or psychological dependence.



    Schedule 9. Prohibited Substance – Substances which may be abused or misused, the manufacture, possession, sale or use of which should be prohibited by law except when required for medical or scientific research, or for analytical, teaching or training purposes with approval of Commonwealth and/or State or Territory Health Authorities.

    I think after reading through the parts relating to nicotine, that vaping comes under this schedule.

    Unless you count yourself as an animal, this does not apply to humans.

    S7
    NICOTINE except:
    (a) when included in Schedule 6;
    (b) in preparations for human therapeutic use;
    (c) in tobacco prepared and packed for smoking.

    (b) in preparations for human therapeutic use.
    If you can convince a judge that it is theraputic to vape, then this applies.

    hmm, i can't open the link at the moment, just get 'bad request' this does not sound good though.
    I wonder how their bans stand up to no nic vaping.
    I suspect this will open a can of worms around here, particularly if it affects imports.

    I wonder if its getting close to court case time, Surely if they can't prove their ridiculous claims either logically or scientifically, these restrictions can be shown to be .. ideological bullshit.

    (b) in preparations for human therapeutic use; or

    from what I can see quickly, the 2012 standard is the same as the 2011 standard with one glaring exception.

    this line has been removed from schedule 2 ..
    'NICOTINE for use as an aid in withdrawal from tobacco smoking in preparations for inhalation.'
